These Terms of Service (“Terms”) govern your access to and use of the Lineage Lines Studio website and services. By utilizing our services or accessing our site, you agree to be bound by these Terms.
1. Scope of Service
Lineage Lines Studio provides custom coloring book services, specifically converting user-provided photographs into precision line-art coloring pages. all three Bundles feature a Physical Spiral-Bound Book Included as a standard deliverable.
2. User Content & Image Submission
- Ownership: You retain all ownership rights to the photos you upload.
- License Grant: By submitting imagery, you grant Lineage Lines Studio a non-exclusive, royalty-free license to use, modify, and process the images solely for the purpose of fulfilling your order.
- Representation: You represent and warrant that you own the rights to the images provided or have obtained express permission from the copyright owner and all individuals depicted in the images.
- Quality Disclaimer: The technical quality of the final line-art is contingent upon the resolution, lighting, and clarity of the source image. We are not liable for suboptimal results stemming from low-quality source files.
3. Intellectual Property
- Studio Property: Lineage Lines Studio retains all rights to the artistic style, proprietary conversion processes, and website content.
- Usage License: Lineage Lines Studio grants the buyer a perpetual, non-exclusive, non-transferable license to use the delivered line-art coloring book for personal, non-commercial use, including home printing and personal social media profiles. Commercial reproduction, resale, or distribution of the artwork or the physical book is strictly prohibited unless an explicit Commercial Use License extension is purchased.
4. Artistic Interpretation
Our service involves subjective artistic judgment. The final output is an interpretation designed for high-contrast coloring and reminiscence activity. It is not intended to be a photorealistic 1:1 replica. By placing an order, you accept this artistic discretion.
5. Payment, Refunds, and Revisions
- Payment: Full payment is required before work commences on any order.
- Refunds: Because each book is custom-made from your photographs, all sales are final once payment is confirmed. If your book arrives with a production defect, our Replacement Policy applies โ see below.
- Revisions:Each order includes one free replacement for clear production defects (e.g., missing pages or damaged binding) reported within 7 days of delivery, as detailed in our Replacement Policy. Subjective revisions regarding artistic interpretation or style choices are excluded from this policy.
6. Data Retention & Privacy
- Purge Policy: Users residing in jurisdictions with statutory privacy protections (including but not limited to the Texas Data Privacy and Security Act and the California Consumer Privacy Act) retain specific rights regarding data access and deletion. To exercise your right to immediate data erasure prior to our standard 30-day purge cycle, contact hello@lineagelines.com.
- Privacy: Use of our site is also governed by our Privacy Policy.
7. Indemnification and Hold Harmless
You agree to defend, indemnify, and hold harmless Lineage Lines Studio, its owners, and contractors from and against any and all third-party claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:
- Content Rights: Your submission of any photograph or digital asset that violates the copyright, trademark, or privacy rights of any third party.
- Unauthorized Use: Your use of the final digital deliverables for commercial purposes without prior written consent.
- Breach of Warranty: Any inaccuracy in your representation that you own or have the necessary licenses for the images provided.
This defense and indemnification obligation will survive these Terms and your use of the Service.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LINEAGE LINES STUDIO, ITS AFFILIATES, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
LINEAGE LINES STUDIOโS TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO ANY PURCHASE IS STRICTLY LIMITED TO THE ACTUAL AMOUNT PAID BY YOU TO LINEAGE LINES STUDIO FOR THE SPECIFIC PRODUCT GIVING RISE TO THE LIABILITY. THIS LIMITATION IS CUMULATIVE AND WILL NOT BE INCREASED BY THE EXISTENCE OF MORE THAN ONE INCIDENT OR CLAIM.
